What Size Cabin Can You Build Without Consent in NZ?

As of 2024, you can build a minor dwelling of up to 60m² on most residential-zoned properties in New Zealand without needing resource consent.

What the 2024 Rule Change Actually Did
The New Zealand government amended the Resource Management Act to allow consent-free minor dwellings, granny flats, secondary units, secondary dwellings of up to 60m² on most residential sites nationwide.
Before this change, resource consent was required for most secondary dwellings regardless of size. That meant council application fees, processing times of 20–40+ working days, and costs ranging from $2,000 to $15,000+ depending on the council and complexity.
Now, for a cabin up to 60m², those requirements are gone for most residential sites. The legislation is fast. This is, genuinely, a useful development.
What 'Consent-Free' Does and Doesn't Mean
Consent-free on the resource consent side does not mean no consents at all.
Building consent is still required. Building consent ensures your structure meets the NZ Building Code, structural integrity, weathertightness, insulation, plumbing, and drainage. This process protects you and the people living in the building. It's not optional and shouldn't be.
Development standards also still apply, even without a resource consent process:
Setbacks from boundaries, typically 1–1.5m minimum from side and rear.
Site coverage, total building footprint as a percentage of section area, typically 40–50%.
Height typically 8m maximum in residential zones.
Character and heritage overlays in some areas may impose additional requirements.
How Big Is 60m²?
60m² is a comfortable one-bedroom home. It's enough for:
A bedroom with a proper wardrobe
A full bathroom
A kitchen with full-size appliances
A living area with room to actually use it
Potentially a small study or second sleeping area depending on layout
For one person or a couple who want their own space on a family property, 60m² is genuinely enough. Not cramped. Not a compromise. A proper home.
What If I Want Something Bigger?
Anything above 60m² in a residential zone requires resource consent. This is a routine application in most residential zones, not a dealbreaker, but it adds time and cost.
For lifestyle and rural zones, the rules differ by council. Many allow larger secondary dwellings with more flexibility than residential zones. A planning consultant familiar with your specific council's district plan can confirm what applies.
