Do I Need Building Consent for a 70m² Cabin in 2026?

This is the right question to ask. And as of 2024, the answer changed in a way that's worth understanding clearly.
Short version: for cabins up to 60m², you no longer need resource consent in most residential zones in New Zealand. But 70m² sits just above that threshold, so let's be specific.

What Changed in 2024
The New Zealand government introduced a rule allowing consent-free minor dwellings of up to 60m² on most residential-zoned properties nationwide. No resource consent application. No council processing fees. No waiting.
This was and we say this as a company that has been building cabins since 2019 a genuinely useful piece of legislation.
What it means in practice:
60m² and under in a residential zone: no resource consent required
Building consent still required, this ensures the structure meets the NZ Building Code, which it should;
Setback, height, and site coverage standards still apply, even without a consent process.
What About 70m²?
A 70m² cabin sits above the consent-free threshold. Which means:
Resource consent is required from your local council.
This is a routine application for most residential zones, not a major hurdle, but it adds time and fees.
Typical resource consent costs range from $2,000–$15,000 depending on the council and complexity.
Processing time varies, but 20–40 working days is common.
Is it worth it? Often yes. 70m² gives you a noticeably more comfortable living space, a proper bedroom, a real lounge, room to have a grandchild stay. For a lot of families, the extra 10 square metres is the difference between a cabin that's tolerable and one that's genuinely a home.
The Building Consent - Still Required Regardless
Whether your cabin is 40m² or 90m², building consent is required.
This covers:
Structural engineering. The cabin won't shift, settle unevenly, or fall over.
Weathertightness. It won't leak, which in New Zealand is not a trivial concern
Insulation. It will be warm. Actually warm. In July.
Plumbing, drainage, and electrical compliance.

What If I'm Outside a Residential Zone?
Rural and lifestyle zones have their own rules, which vary by council. In many cases they're more permissive, a rural-zoned block over 4,000m² may allow a secondary dwelling with minimal restrictions. In some cases they're more complex.
The Western Bay of Plenty District Plan, for example, has specific provisions for rural residential and lifestyle blocks that differ from Tauranga City's residential zones. A planning consultant can clarify your specific situation in a single call, usually faster and cheaper than people expect.

Cabin 60m²+ in a residential zone: resource consent + building consent
Rural or lifestyle block: check with a planning consultant first, often more flexibility than people expect.
